Administration of the scheme

The Tasmanian asbestos compensation scheme is administered by the Asbestos Compensation Commissioner. The Commissioner’s function is to administer the Asbestos Related Diseases (Occupational Exposure) Compensation Act 2011 (the Act).

The Commissioner can decide all matters regarding a claim for compensation including whether compensation should be awarded.

Under the Act, the Commissioner is also required to:

  • manage and administer the investments under the Asbestos Compensation Fund; and
  • advise the Minister on issues relating to the Act

A worker or a family member of a deceased worker affected by a decision of the Commissioner regarding a claim for compensation may appeal against the decision to the Asbestos Compensation Tribunal.
